Terms of service

The agreement between your business and Diwaan, in plain language.

Agreement

These terms are an agreement between Diwaan and the business that signs up for Diwaan (“you”). By creating an account or using Diwaan, you agree to them on behalf of your business. If you do not agree, do not use Diwaan.

Your account

  • Give accurate details when you sign up and keep them up to date.
  • Keep sign-in details private. You are responsible for what happens under your account, including what your staff do.
  • Give each person their own sign-in or till code, so the audit trail shows who did what.

Free trial

Diwaan is free while we launch, with every part included and no card needed. Before anything is ever charged, you will be told in advance and can choose to stop and export everything. Nothing is deleted or locked for not paying.

Editions, fees and payment

  • Fees depend on your edition and any add-ons, and are shown before you confirm.
  • Monthly plans are billed each month in advance. Yearly plans are billed once a year in advance.
  • Moving to a larger edition takes effect at once and is charged for the remaining days. Moving to a smaller edition takes effect at the next billing date.
  • If a payment fails, we tell you and try again. If it is still unpaid after 14 days, we may limit the account to read-only until it is paid.
  • We will give you at least 30 days' notice of any price change.

Your records

Your business owns the records it keeps in Diwaan. You give us permission to store and process them only to provide the service. You can export them at any time, in standard formats.

You are responsible for the accuracy of what you enter, for the tax rates you set, and for meeting the accounting and tax rules that apply to your business. Diwaan applies your settings exactly, but it does not give legal, tax or accounting advice.

Acceptable use

Do not use Diwaan to break the law, to store information you have no right to hold, to attack or overload the service, or to try to reach other customers' records. We may suspend an account that does, and we will tell you why.

Availability and support

We work to keep Diwaan available at all times and publish live status on our status page. Planned maintenance happens outside common trading hours and is announced in advance. Diwaan POS keeps selling offline during any interruption.

Support is available by email on every edition, and by phone on Diwaan Business and Group.

Changes to Diwaan

We improve Diwaan continually. We will not remove a feature your edition depends on without at least 60 days' notice. API versions are supported for at least 12 months after a newer version is released.

Liability

We are responsible for providing the service with reasonable skill and care. To the extent the law allows, our total liability in any 12 months is limited to the fees you paid in that period, and we are not liable for indirect losses such as lost profit. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can cancel at any time in Settings, then Billing. Your account stays open until the end of the period you have paid for. We keep your records for 90 days after closing so you can export them, then delete them.

We may end the agreement with 30 days' notice, or at once if you seriously break these terms.
